2 19-08-2014 Heard learned counsel for the Petitioner and the State. The Petitioner seeks quashing of the order dated 28.6.2014 passed by the A.D.J.VII-cum-Special Judge, N.D.P.S., Patna, in connection with Special Case No. 69 of 2013 arising out of Bakhtiyarpur P.S. Case No. 226 of 2013.

It has been submitted that even though it has been mentioned in the impugned order that Confiscation Proceeding is going on of the vehicle in question, and, hence, the Additional Sessions Judge VII-cum-Special Judge, N.D.P.S., Patna, has refused to release the vehicle, seized in Special Case 69 of 2013 arising out of Bakhtiyarpur P.S. Case No. 226 of 2013 but fact of the matter is that no Confiscation Proceeding has been initiated as yet.

The matter is remanded to the Court below to call for a report in the matter and pass an appropriate order within a period of four weeks from the date of receipt of the report.
