The petitioner, apprehends his arrest in connection

with a case registered for the offence punishable under Sections 304B, 120B/34 of the Indian Penal Code.

Learned Additional Public Prosecutor for the State who pointed out that petitioner is one of the named accused in this case of recovery of dead body of petitioner’s wife by the police who arrived on some information on telephone and got this case alleging some sort of torture, demand of dowry etc. resulting into death of deceased within four years of her marriage.

Submission is of false implication with ulterior motive and parents of the deceased themselves have filed an application before the court below stating actual state of affairs and exonerating the petitioner and others. Petition is on the record of the court below.

If, it is so, and parents of the deceased appearing before the court below on due identification support filing of such application dated 27.08.2013 and contents there in with their freewill and consent without any coercion and duly appreciating the

implication and father of the deceased also stood as one of the bailors, in the event of his arrest/surrender before the court below within four weeks, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar, in connection with Kadwa (Balia Belone) P.S. Case No. 144 of 2013 , subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure with additional condition to remain physically present before the court below on each and every date at least for two years or till disposal of the case, whichever is earlier and in case of failure on two consecutive dates without giving any reasonable explanation, the liberty granted shall be deemed to be cancelled.
