Perused the records.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307 and 504 of the Indian Penal Code.

Heard learned Additional Public Prosecutor for the State, who pointed out that in this case of assault in a petty dispute there is counter version also by way of Nathnagar P.S.Case no. 239/2013 but the parties have amicably settled the dispute and filed due application of compromise in both the cases.

Having regard to the facts and circumstances of the case,

court below and on due identification support the factum of compromise with their free will and consent without any coercion, in the event of their arrest or surrender before the court below within four weeks, let above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur, in Nathnagar (Madhusudanpur) P.S.Case no. 238/2013 corresponding to G.R.No. 2666/2013, subject to the conditions as laid down u/s 438(2) Cr.P.C. with additional condition to remain physically present before the court below on each and every date at least for two years or till disposal of the case, whichever is earlier and in case of failure on two consecutive dates without giving any reasonable explanation , the liberty granted shall be deemed to be cancelled.
