The petitioner seeks regular bail in a case registered under Sections 3/4/5/6/7 of the Immoral Traffic (Prevention) Act.

Allegedly the petitioner was caught with a man in Room No. 9 of Kumar Rest House in compromising condition. She disclosed that she has been frequently visiting the hotel on call.

Submission at the Bar for release of the petitioner is that she being the lady is in custody since 15/05/2014. She has been made victim of the circumstances. She has been purposely roped in this case and there is no independent witness.

In the facts and circumstances, as stated above, considering that the petitioner being lady, let she (Soni Devi) be

released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in Khagaria P.S.Case no. 285 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall also remain present on each and every date during trial and the default on two consecutive dates on her part without any reason shall disentitle the petitioner from privilege of bail.
