The petitioners seek bail in Dandkhora P.S. Case No. 49 of 2014, registered for the offences punishable under Section 392 of the Indian Penal Code.
The informant named the petitioners and alleged that the petitioners forcibly committed theft of two tones of iron rod and one motor from the site of the construction company.
Learned counsel for the petitioners submits that the petitioners are innocent and they purchased iron rod. The informant is his co-villager. It is most difficult for three persons to carry two quintals of iron rod. Petitioners have got no criminal antecedents and they are in jail since 18.05.2014, 16.05.2014 and 26.06.2014 respectively.
Learned APP did not dispute the facts.
Having considered the fact that the petitioners are alleged to have carry two quintals of iron rod and for that petitioners have remained in jail for about seven months and they have got no criminal antecedent, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Dandkhora P.S. Case No. 49 of 2014.
