2 20-01-2014 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks anticipatory bail in connection with a case registered for the offences punishable under Sections 307, 498A read with Section 34 of the Indian Penal Code as also Sections 3 and 4 of the Dowry Prohibition Act.

It is contended that there is no truth behind the allegation of subjecting the informant to cruelty for nonfulfillment of demand of dowry. As a matter of fact, even prior to the filing of the present case due to incompatibility between the parties a matrimonial case seeking decree of divorce was already filed by the petitioner and on receipt of notice in the said case, the

present FIR was instituted in retaliation.

Be that as it may, considering the facts and circumstances of the case, in the event of arrest or surrender in the Court below within a period of six weeks from the date of receipt/production of a copy of this order, the above named petitioner shall be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Mithanpura P. S. Case No.205 of 2013, subject to the conditions as laid down under Section 438(2) Cr. P.C.
