05/ 23.12.2014 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. No one appears on behalf of the opposite party no.2.
Petitioner apprehends his arrest in connection with Mohania P. S. case no. 301/2013 registered under sections 406 and 420 of the IPC.
The accusation against the petitioner is that he being mill owner lifted paddy from the godown of FCI on the agreement with assurance that he will return rice but neither rice nor amount was returned to the FCI and it is alleged that the petitioner defalcated the above stated amount.
The contention on behalf of the petitioner is that certificate case was imitated against the petitioner but a bench of this court quashed the aforesaid certificate case. It is also pointed out on behalf of the petitioner that several cases were registered against different

persons and some persons have already been granted anticipatory bail
by different benches of this court. To fortify the above stated contention, he drew my attention towards annexure 5 to this petition.
In view of the aforesaid submissions as well as facts and circumstances, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in Mohania P. S. case no. 301/2013 subject to condition as laid down under section 438(2) of the Cr.P.C.
