A supplementary affidavit on behalf of the petitioner has been filed stating therein that the petitioner has deposited both the instalments, each in sum of Rs. 65,000/-, as directed by this Court under order dated 19.04.2014 whereby he was directed to surrender within four weeks subject to deposit of first instalment in sum of Rs. 65,000/- whereafter the court below was directed to release him on provisional bail for a period of two months and on production of receipt showing deposit of another instalment in the sum of Rs. 65,000/- with the Distribution Company (opposite party no.2), the bail bonds so furnished by the petitioner were directed to be confirmed.

Initially, the application was filed seeking extension of time for his surrender for the reasons stated therein.
It has been submitted by learned counsel for the petitioner that since both the instalments as directed by this Court have been deposited the period for surrender be extended and the court below be directed to release the petitioner on bail.
Considering the facts and circumstances of the case, this Court directs that in the event of arrest/surrender within three weeks from today, the learned court below(Chief Judicial Magistrate, Vaishali at Hajipur) shall release the petitioner above named on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the lime amount each to its satisfaction in connection with Ganga Bridge P.S. Case No.107/2013 subject to condition as laid down under section 438(2) Cr. P.C.
