It is submitted that the petitioner has been falsely implicated and in any event he is alleged to be only the order giver and no overt act has specifically been alleged against him. There is case and counter case, the other side being the aggressors. The petitioner’s side have received grievous injuries whereas the injuries attributed to have been caused by the petitioner’s side are simple in nature. The parties are all related to each other and

because of altercation due to land dispute in which the informant’s side had filed Misc. Appeal No. 26/2012, the present occurrence is said to have taken place. The petitioner claim clean antecedent.

Having regard to the entirety of the facts and circumstances of the case, in the event of the petitioner’s arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Nath Nagar PS Case No. 121/2014 subject to the conditions laid down under section 438(2) of the Cr.P.C.
