Santosh Kumar, who proceeded to Ramjanpur Dhabauli Chowk on 18.10.2013 at 6.00p.m. did not return and his dead body was found on the following day at Usraha orchard for which informant Ram Bahadur Thakur, his father has shown suspicion against Mithun Kumar Thakur, who happens to be on litigating term with deceased as well as against Chandra Dev Thakur, Fufa of Mithun. Vishal Thakur (petitioner) maternal uncle of Mithun along with 2-3 unknown persons whose presence he had perceived on 18.10.2013 and who have also been found absent after recovery of dead body.

accused Mithun Kumar Thakur @ Mantun Kumar Thakur had already been granted bail vide Cr. Misc. No.28302 of 2014 and Chandra Dev Thakur vide Cr. Misc. No.8557 of 2014. Case of the petitioner stood on similar footing.
On the other hand, learned Additional Public Prosecutor fairly concedes.
Accordingly, petitioner Vishal Thakur is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ad hoc Additional Sessions Judge-II, Begusarai in connection with Sessions Trial No.881 of 2013 arising out of Neema Chandpura P. S. Case No.89 of 2013.
