The petitioner apprehends his arrest for the offences alleged under sections 302 and 201 of the Penal Code registered in connection with Andharathari PS Case No. 41/2013.

It is submitted that the petitioner, who claims clean antecedent, has been falsely implicated on mere suspicion as there is no eye witness to the alleged occurrence and he himself is suffering and is in the last stage of cancer. After due investigation the police has submitted charge sheet against other co-accused while exonerating the petitioner.

Having regard to the entirety of the facts and circumstances of the case, in the event of the petitioner’s arrest or

surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Jhanjharpr in connection with Andharathari PS Case No. 41/2013 subject to the conditions laid down under section 438(2) of the Cr.P.C. with additional conditions that the petitioners will be well represented on each and every date and if he fails to do so on two consecutive dates, their bail bonds will be liable to be cancelled by the learned court concerned.
