The case of the Complainant is that when her son was taken forcibly for giving his statement, she went to intervene and charged the Investigating Officer about his action, at which he being enraged assaulted and abused her and also took away her personal possessions.

It has been submitted on behalf of the Petitioner that the admitted position is that Cheriyabariyarpur P.S. case No.108 of 2012 was instituted by the Complainant for the kidnapping of her son and when the police took the victim for examination she protested and thereafter filed the present case.

petition, I have no manner of doubt that it is completely misplaced and deserves to be set aside.

Hence, the application is allowed and the order dated 6.6.2013 passed by the Judicial Magistrate, 1^st class, Begusarai in Complaint case No.2261C of 2012 is set aside.
