After administering poisonous substance to the informant all his belongings enlisted therein was taken away by unknown miscreant. During course of investigation the stolen mobile set was put on surveillance found being used by the petitioner on account thereof, he was apprehended and from his possession the stolen mobile set was recovered.
It has been submitted on behalf of petitioner that just after his apprehension petitioner had disclosed that he had purchased the same from Jitendra Paswan, son of Ram Shankar Paswan of village-Kharat, P.S.-Masaurhi, District-Patna. It has also been submitted that from para-14 of the case diary, it is evident that petitioner has got no criminal antecedent. It has also been submitted that petitioner happens to be under custody since 15.03.2014.

The learned Additional Public Prosecutor opposed
the prayer. Accordingly, petitioner Suraj Mistry is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Railway Judicial Magistrate, Patna in connection with G.R.P.
