The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 149, 447, 341, 342, 323, 326, 307, 504 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added registered in connection with Singhiya P.S. Case No. 74 of 2013.

Accusation is that the accused persons including the petitioners came variously armed whereupon assault was made on the informant and members of his family.

It is submitted that there is case and counter case involving injuries on either side. In any event the

accusations are specifically attributed to the other accused persons and no overt act whatsoever has been attributed to the petitioners herein nor has it been specifically stated what arms they were carrying.

Considering the above facts, as such, in the event of the petitioners’ arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rosera, Samastipur, in connection with Singhia P.S. Case No. 74 of 2013, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
