Heard learned counsel for the petitioner and learned counsel for the State.
The present application under Section 482 of the Code of Criminal Procedure has been filed for quashing of the order dated 27th September, 2012 passed by Sri Anjani Kumar Gaur, Judicial Magistrate 1st Class, Khagaria in G.R. Case No. 1013 of 2012 arising out of Gogri P.S. Case No. 97 of 2012 by which he has taken cognizance of the offence punishable under Section 409 of the Indian Penal Code against the petitioner.
After some arguments, learned counsel for the petitioner seeks leave to withdraw the present application in order to raise all the points available to the petitioner at the stage of framing of charge.
