Deepak Singh, deceased son of Bhola Singh was accompanied by Sanjeev Singh and Deepak Singh (petitioner) from his house was shot dead. Hearing sound of firing, informant Bhola Singh and his wife rushed to the place, near the shop of Sitesh Singh and during course thereof, they have seen one person sitting over motorcycle as pillion rider and thereafter escaped therefrom. They have made query from Sanjeev Singh as well as Deepak Singh (petitioner), but they did not speak anything and on account thereof, shown suspicion against petitioner and Sanjeev Singh at whose behest the miscreants shot dead deceased.
It has been submitted on behalf of petitioner that even at the time of occurrence, thereafter petitioner along with

Sanjeev Singh was present at the place of occurrence where deceased was shot. Instead of petitioner including Sanjeev Singh categorized as witness of the occurrence has been named as an accused. Sudhir Sah, Para-10 and Rajesh Singh, brother of Sitesh Singh, Shopkeeper, para-11 have not disclosed the petitioner to be assailant of deceased.
On the other hand, learned Additional Public Prosecutor opposed the prayer and submitted that petitioner along with Sanjeev Singh happens to be the conspirator whereunder deceased Deepak Singh was shot.
Taking into account the nature of evidence, petitioner Deepak Singh @ Deepak Kumar i s directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in connection with Tariyani P. S. Case No.105 of 2013.
