Contention on behalf of petitioner is that the so alleged victim happens to be his wife. Due to differences in between the spouses, the instant case has been filed. To support the contention, Annexure-2, copy of complaint case bearing no. 1328/2010 filed by Indrawati Kuer, mother of victim has been filed wherefrom, it is evident that she had incorporated the fact that she is staying in the house of her son-in-law, Mukesh Kunal, an Advocate. Other documents have also been filed on that very score along with supplementary affidavit wherefrom it is evident that petitioner had claimed to be purchaser of KVP bearing nos. 7435, 7436, 7437, 7438 & 7439 in the name of victim having himself as nominee as well as possessing Account No. 070010024242 in his name wherein Pinki Kumari Gupta @ Priya Singh and Indrawat Kuer happen to be nominee and that is the reason behind divulging in written report that petitioner was taking her away for the purpose of marriage. It has further been submitted that in the aforesaid background, whatever allegations happen to be, legally not tenable. Also submitted that petitioner happens to be under custody since 15.12.2013.
