The petitioners seek bail in a case instituted under Sections 302/34 and 201 of the Indian Penal Code.

The prayer for bail of the petitioners was rejected earlier by this court vide order dated 12^th of April, 2012. Petitioners are in custody since 4^th of August, 2009 and 7^th of December, 2009 respectively.

Chapra vide letter dated 8^th of May, 2013 has reported that after commitment of the case charges were framed against the petitioners on 8^th of June, 2011 and since then all possible steps have been taken for securing attendance of the witnesses but till date the prosecution has failed to produce any witness in support of the charges.

Considering the facts and circumstances of the case, petitioners are directed to be released on bail on furnishing bail bond of Rs. 10, 000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Adhoc Additional District and Sessions Judge, Saran at Chapra in connection with Amnaur (Bheldi) P.S. Case No. 25 of 2007.
