Allegedly loaded truck was forcibly looted away after showing fear of shooting to the informant and during investigation it has come that from the place of the petitioner looted 44 delivery pipes were recovered on the basis of confession of co-accused.

Submission at the bar is that the petitioner is not named, he has got no criminal antecedent, he has not been put on Test Identification Parade though he is in custody since 18.12.2013, the petitioner purchased those delivery pipes from

Md. Nasir in good faith which Md. Nasir has also admitted and besides that there is no other material against the petitioner to which the learned Additional Public Prosecutor also concedes.

In the facts and circumstances as stated above and considering the alleged recovery and detention of the petitioner at this stage, the petitioner Nitesh Singh @ Rocky Singh is directed to be released on bail on execution of bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-divisional Judicial Magistrate, West, Muzaffarpur in connection with Maniyari P.S. Case No. 273 of 2013 with conditions that one of the bailors must be near relative and the other having sufficient immovable property within the jurisdiction of the trial court and the petitioner shall remain present on each and every date during the trial and two consecutive defaults without any reasonable cause shall disentitle the petitioner from the privilege of bail.
