The petitioner apprehends his arrest for the offences alleged under Sections 420, 406, 471, 472, 473, 474, 475 and 476 IPC registered in connection with Siwan (T) P.S. Case No. 409 of 2012.

It is submitted that the petitioner was the Assistant Godown Manager of State Food Corporation, Mitha Mill and has been falsely implicated considering his repeated letters to the District Manager, State Food Corporation, Siwan with regard to the godown being in a state of disrepair leading to every likelihood of damage to the rice lying therein.

In any event the petitioner is prepared to deposit a sum of Rs.2,00,000/- being the approximate amount calculated at 15% of the value of undistributed rice of 1370.57.148 quintals @ Rs. 10/- per kilogram.

Having regard to the entirety of the facts and circumstances, as such, in the event of the petitioner’s arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan (T) P.S. Case No. 409 of 2012 subject to the conditions as laid down under Section 438 (2) Cr.P.C., and further subject to the following conditions-

i) that the petitioner shall deposit a sum of Rs.2,00,000/-(two lakhs) before the learned Court below in the form of cash, fixed deposit or N.S.C., within a period of six weeks from today and such deposit shall be subject to final result of the trial.

ii) that the petitioner shall remain personally present on each and every date and if he fails to do so on two

consecutive dates, his bail bond will be liable to be cancelled
