3 22-07-2014 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in Sherghati P.S. Case No. 103 of 2013 dated 19.03.2013 instituted under Sections 307/326/34 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner submits that he is not named in the F.I.R. and on the confessional statement of coaccused, Satish Manjhi, he has been implicated in the case. It is

submitted that the petitioner is in custody since 11.06.2013.

Learned A.P.P., upon going through the case diary, submits that as per the confessional statement the petitioner is said to be one of the persons who was on the motorcycle when the incident occurred. Learned counsel further submits that the petitioner has eight other cases against him under serious sections of the Indian Penal Code.

Considering the facts and circumstances of the case and submissions of learned counsels for the parties, the Court is not inclined to enlarge the petitioner on bail.

Accordingly, the application stands dismissed.

However, the court below shall expedite the trial and

conclude the same within six months.
