The petitioner seeks bail in Sri Krishnapuri P.S. Case No. 523 of 2013 dated 31.12.2013 instituted under Sections 406/420/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that as per the F.I.R. itself it is clear that one Raj Kumar Chaddha was the person who had committed the fraud and the petitioner along with another were his agents only to the extent of working in his office. In the F.I.R. itself it has been stated that the petitioner along with others had collected the passport and money and in their presence the same were handed over to Raj Kumar Chaddha who asked them to proceed to a Restaurant and from where Raj Kumar Chaddha, on the pretext of getting new year gift, ran away. submitted that there is no allegation that the passport or the money was returned by the petitioner and he has clean antecedent being in custody since 02.01.2014.

Learned A.P.P., upon going through the case diary, does not dispute the aforesaid fact that as per the allegation, the money and the passport of the informant and others was handed over to Raj Kumar Chaddha.

Considering the facts and circumstances of the case and submissions of learned counsels for the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1^st Class, Patna in Sri Krishnapuri P.S. Case No.523 of 2013. The petitioner and the bailors shall execute bond with regard to good behaviour of the petitioner. The petitioner shall also give an undertaking to the Court that he shall not indulge in any criminal activity. Any violation of the terms and conditions of the bonds or the undertaking shall lead to cancellation of his bail bonds.
