The petitioner, apprehends his arrest in connection with a case registered for the offence punishable under Sections 147, 302 and 120(B) of the Indian Penal Code and 27 of the Arms Act, is one of the named accused in this case.
Submission is of false implication and taking into consideration that there is no eye witness to the occurrence. One of the co-accused Birendra Rai has already been granted privilege by a Bench of this Court vide order dated 21.03.2014 passed in Cr. Misc. No. 8 of 2014. Further, petitioner carries no criminal antecedent.
If, it is so , having regard to the facts and circumstances of the case, in the event of his arrest/surrender before the court below within four weeks, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P.S. Case No. 429/2013 , subject
