The petitioner, apprehending his arrest in connection with Bodh Gaya P.S. Case No.153 of 2013, registered for the offence under Section 302 of the Indian Penal Code and Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities ) Act ( hereinafter referred to as the “ SC/ST Act”), has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that only on suspicion, the petitioner has been made accused, since the informant had alleged that the deceased had gone along with petitioner, whereas during investigation one Tempo Driver has made statement that death has occurred due to accident while the deceased was crossing a road. Of course, in the case diary, this statement was got contradicted. It has further been argued that the

petitioner himself belonged to Schedule Caste category and, as such, SC/ST Act is not applicable in the present case.

In view of the facts and circumstances, particularly the fact that the investigation is still continuing and there is only suspicion, none has seen the occurrence, at this stage the petitioner can be extended the privilege of anticipatory bail. Let the petitioner, namely, Pappu Ravidas be enlarged on bail, in the event of his arrest or surrender within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No.153 of 2013, subject to the condition as laid down in Section 438(2) of the Code of Criminal Procedure. If, however, after investigation chargesheet is submitted and the petitioner is made accused, the petitioner will have to surrender and make a prayer for regular bail.
