today is not being contested by Mr. Binod Bihari Singh appearing for some of the opposite parties. However, now that the certified copy has been handed over to the opposite parties/encroachers who have applied for the same together with requisite stamps, nothing further survives in this contempt application. The affected parties shall be at liberty to take recourse to such remedies as may be available to them under the provisions of Bihar Public Land Encroachment Act, 1956.
As the show cause filed on behalf of the State manifests that all the alleged encroachers had been duly noticed about the proceedings and pursuant whereto some of them appeared and contested while fewer applied for a certified copy of the order passed in the proceedings and since the enactment provides for filing of an appeal within 30 days of the order passed by the Collector under the Act, it is expected that no steps in furtherance of the impugned order is taken by the Collector under the Act until the expiry of one month from today.
This is for the sole purpose that the contesting parties may take recourse to the remedy that is available to them under the Act within this period.
This disposes of the contempt application but with the observation aforementioned.
