This appeal under Order 43 Rule 1(r) of the Code of Civil Procedure (hereinafter referred to as the ‘Code’) questions the order dated 17.1.2013 passed by learned Sub Judge 1st , Buxar in Revocation Case No. 12 of 2012 arising from Probate Case No. 12 of 2012 whereby the trial Court has allowed the petition filed on behalf of the applicants-respondents under Order 39 Rules 1 and 2 of the Code requiring the parties to maintain status quo. While the appellant herein claim to be the legatees under the Will dated 6.9.1923 executed by one Bhagwati Sahay which was probated under the orders passed by the Court below in Probate Case No. 12 of 2012, the order so passed has been contested by the respondents by filing Revocation Case No. 12 of 2012.
