The present petition has been filed in respect of the alleged non-compliance of the order dated 6.11.2012 passed by this Court in CWJC No. 20518 of 2012, inter alia, requiring the Child Development Project Officer, Dhoraiya, District Banka to forthwith to give effect to the observations and directions of the District Programme Officer, Banka in the matter of payment of dues to Anganwadi Sevikas, and in the event the petitioners be not found eligible for the same, to pass

a reasoned order in that regard.

A show cause has been filed on behalf of the Child Development Project Officer, Dhoraiya, Distt. - Banka (OP No.6). It has been stated that even prior to disposal of the writ petition, an enquiry report had been submitted on 8.10.2012 before the District Magistrate, Banka finding irregularities in the appointment of 42 Anganwari Sevikas including these petitioners, pursuant to which by letter No. 1909 dated 30.10.2012 their selection had been cancelled. A stand has further been taken that the take home ration was never given to the petitioners and as such they had never worked as Anganwadi Sevikas after their selection. A reasoned order dated 2.1.2013 has since been passed by O.P. No. 6 (Annexure-E), as had been directed by this Court.

In the facts and circumstances, this Court is unable to find any willful disobedience on the part of the O.P. No. 6 as the order dated 6.11.2012 stands complied with in terms of the aforesaid reasoned order passed by O.P. No. 6.

The Contempt petition accordingly stands disposed of.

Needless to say, the petitioners would be at liberty, if aggrieved by order dated 2.1.2013, to question the same in a duly constituted proceeding before an appropriate forum in accordance with law.
