3 24-04-2013 Heard learned counsel for the parties.
The petitioner’s grievance in this writ application as
can be culled out from the following prayers made by him,
“1(i) For a direction to the Respondents authority to
grant the benefit of first A.C.P. (Assured Career
Progression) to the petitioner with effect from
1.1.2002 because he has completed twelve years of
regular service and he has not been granted any
promotion.
(ii) For a direction to the Respondents authority to pay
the enhanced increment of the salary with effect
from 1.1.1990 of the petitioner who is Chaukidar
in Revelganj Police Station of the Saran District.
(iii) For a direction to the Respondents authority to pay
immediately the arrear of salary of the petitioner
in revised salary of the Fifth Pay Commission.”
seems to be actually two fold namely that after the petitioner was
absorbed as a Chaukidar by making him a government servant in
terms of the government policy, he has not been paid the arrear of
