Having regard to the nature of claim of reimbursement of the medical bill for the treatment undergone by the petitioner, this Court in view of the uncontroverted statement made in the counter affidavit that the petitioner had never approached the authorities for such reimbursement much less had informed the prescribed authority with regard to his being treated in a private nursing home, this Court for the time being is

When such observation has been made the petitioner has submitted that he may be allowed to represent his case before the authorities and comply the Government Rules and Procedure for reimbursement of the medical bills.

That being so, this application is, accordingly, permitted to be withdrawn with a liberty to the petitioner to first fulfil the requisite conditions for reimbursement of the medical bills as explained in the counter affidavit and thereafter approach the competent authority seeking sanction of post facto approval to the treatment undergone by him and the consequential payment of the admissible medical bills.

In view of the fact that the petitioner has already retired, if the petitioner approaches the authorities they must decide the issue with compassion and if the Rules permit, the medical reimbursement should also be made to the petitioner at an early date preferably within a period of four months from the date of filing of the application by the
