2 02-07-2013 From the impugned Annexure-6 which is dated 11.07.2007 it appears that the BIADA had allotted a plot to the petitioner’s unit upon cancellation of the allotment of the same plot to another unit. That cancellation order was challenged by the said unit before the Industrial Tribunal Commissioner who set aside the cancellation of order and ordered for restoration of the allotment to that unit. In the circumstances, by this order, the allotment of the said plot to the petitioner’s unit has been cancelled.

Learned counsel for the petitioner submits that the petitioner has filed a representation before the Executive Director on 03.08.2007 for consideration of his case which still remains

pending.

Since this writ application has been filed in 2013, i.e., almost six years after the cancellation order was passed, this Court is not inclined to entertain any plea on behalf of the petitioner on merits. The same is accordingly dismissed.

However, if the representation of the petitioner is pending,

he is at liberty to pursue the same.
