2 01-07-2013 From the order of the learned Sessions Judge, as contained in Annexure-7, it appears that he has allowed bail to the petitioner in anticipation of his arrest or surrender on his undertaking that he will pay installment of Rs.28,063/- every month to the Board against loss amount of Rs.2,80,624/-.

Learned counsel for the petitioner submits that the petitioner has already paid three installments and he is ready to pay Rs.60,000/- more which will come to 50% of the loss amount. Thereafter, the Board may be directed to restore his electric line on provisional basis which may be subject to result of the final assessment order.

If the petitioner deposits Rs.60,000/- with the Board, the Board shall restore his electric line on provisional basis with a new tested meter, if necessary, within 72 hours, which shall be subject to the result of the final assessment proceeding and the petitioner paying further installments as per undertaking given to the learned Sessions Judge. This Court also directs that the final assessment proceeding should be concluded and final orders should be passed within two months from the date of receipt/production of a copy of this order.

The writ application is disposed of with the aforesaid observations and directions.
