Learned counsel for the petitioner, after some argument, seeks permission to withdraw this application with a liberty to prefer an appeal against the impugned order. The permission is accorded.

This application is, accordingly, dismissed as withdrawn with the liberty as aforesaid. However, it is observed that if such appeal is preferred before the appropriate court within one week from today, the court below will consider condoning delay in filing such appeal and will take into account the fact that petitioner had been pursuing his remedy before this court by filing the present application under Article 227 of the Constitution of India.
