Heard learned counsel for the petitioner and the
State.
Though this case has been filed in the year 2010 but no counter affidavit has been filed on behalf of the State as yet.
However, in view of the limited prayer made at the time of hearing, this writ application is being disposed of without going into the merit of the case directing the Anchal Adhikari, Kudra to dispose of Encroachment Case No.01 of 2009-10 on its own merit and in accordance with law within three months from the date of production of a certified copy of this order, if the same has already not been disposed of.
