5 26-02-2013 Heard learned counsel for the petitioner and learned counsel for the State. The petitioner has approached this Court for payment of an amount of Rs. 59,410/- with respect to certain contract works done by him for the construction of boundarywall of the school.
In the counter affidavit the stand taken is that the admitted dues have not been paid due to non-availability of fund under the Sarvshiksha Abhiyan as the funds under the said head had been refunded to the Treasury in view of the letter dated 10.8.2010 received from the Principal Secretary, Education Department. It is also stated that request has been made to the Director, Primary Education, Bihar by letter dated 22.1.2013 for allotment of fund.
