During the pendency of this application the petitioner is stated to have superannuated from the service of the said school w.e.f. 31.5.11. According to the petitioner, one post of Clerk was sanctioned for the said school. The petitioner was paid thereagainst. According to the respondents, the school in which the petitioner claims to have worked had no sanctioned post of Clerk. Various orders have been placed on record to show that the petitioner was not entitled to payment of salary since the post on which he claims to have been worked was never sanctioned . It is surprising that the petitioner was not paid since 1995 and still he continued to work without raising any issue in this regard until filing of the writ petition in the year 2009. This Court is not inclined to interfere in the matter by invocation of discretionary writ jurisdiction. However, considering the fact that the claim of the petitioner is that he was entitled to payment of salary since the post of Clerk was available in the said school which again requires verification of several records/documents, this Court would permit the petitioner to make a fresh claim/representation in this regard before the Special Director, (Sanskrit) Govt. of Bihar ( respondent no.6) within four weeks along with all relevant papers in his possession.
