Heard learned counsel for the petitioner as well as leaned counsel for the Bihar School Examination Board, Patna (in short the Board).

The petitioner prays for a direction to the Board to correct his date of birth as 5.8.1978 in place of 1.3.1977 in its record and its original matriculation certificate bearing No.91C 000323326 dated 30.7.1991.

The petitioner appeared in the Matriculation examination conducted by the Board in the year 1991 from Government Tirhut Vidyalaya, Mehsi. The Board issued Admit card to the petitioner which contained the following details:Registration No. 0552030/03203 of 1990, Roll No.146, Roll Code 5504 and date of birth as 05.08.1978. A photo stat copy of the admit card is annexed to the writ petition as Annexure 2A. He

submits that school register also shows his date of birth as 5.8.1978.

A counter has been filed on behalf of Board. Learned counsel for the Board states that in the Tabulation register petitioner’s date of birth is entered as 1.3.1977. The Board states that it can correct its printing mistake in its record only on the basis of original admission register, original T.C. guard file, and original admit card and original registration slip. They state that they have twice written to the Headmaster, Tirhut Vidyalaya, Mehsi, and East Champaran for production of the required documents, once on 7.1.2009 and again in its Letter no. 919 dated 3.9.2013, awaiting response.

In view of counter affidavit of the Board, the Headmaster of Tirhut Vidyalaya, Mehsi is directed to make available required documents to the Board within six weeks from the date of receipt/production of a copy of this letter. Petitioner would also produce the admit card (Annexure 2A) issued by the Board. The respondents no. 2 and 3 would take appropriate action as soon as the required documents are received, preferably within six weeks thereof.
