JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 02 12-11-2013 The two petitioners are brothers. From their house, which is also their business premises in the village, 700 bags of various fertilizers were seized on 02.12.2012 by the SubDivisional Agriculture Officer, Sitamarhi East. Fertilizers were also seized from other places with which petitioners are not concerned. Subsequently, an F.I.R. was lodged, giving rise to Bela P.S. Case No.117 of 2012 dated 02.12.2012, ostensibly for committing an offence punishable under Section-7 of the Essential Commodities Act. A reference to the first information report states that the informant had received that fertilizers were being stored for the purposes of carrying them with bicycle into Nepal, which was illegal. Admittedly, the fertilizers were not got in transit.
