04 01-11-2013 The petitioner is a domestic consumer. He complains that his electric meter has been illegally functioning and repeatedly changed. The last change was made in March, 2013. The petitioner received a bill which contained arrears of over Rs.2 lakhs and current bills, non-payment whereof, ultimately laid to the disconnection of is residential house.

He challenges the validity of the bill and the propriety of arrears because he was never in default. He submits that had he been in default his electric connection would have been disconnected and there could be no replacement of meter by new meter.

learned counsel for the Bihar State Power (Holding) Company Limited, in my view, the appropriate Forum to raise his grievance would be the Consumer Grievance Redressal Forum as constituted under Section-42 (5) of the Electricity Act, 2003, which is now fully functional. However, upon petitioner paying an amount of Rs.50,000.00 and also getting his load enhanced his electric connection would be connected within 48 hours. For any further interim order, it would be open to the petitioner to move the Consumer Grievance Redressal Forum whose decision would be binding on the parties in accordance with law. In the meantime, the petitioner would however be liable to keep paying the current electricity bills for current consumption. The Consumer Grievance Redressal Forum would decide the dispute and resolve the same expeditiously and, if possible within four months, subject to cooperation of the parties.
