/ diploma for the post of Technical Supervisor (Engineer). They applied for the post of Technical Supervisor in the light of advertisement published in daily ‘Hindustan’ on 24.8.2006 by the Bihar Education Project, Rohtas. After due scrutiny, a panel of thirty nine candidates was prepared by respondent no.5 (District Superintendent of Education cum District Project Coordinator) in which the names of petitioners also figure. According to the petitioners, the name of petitioner no.1 figures at serial no.11 and that of petitioner no.2 is at serial no. 7. As per requirement the petitioners too gave their consent within the prescribed time. As no appointment letter was issued, the petitioners represented to the District Magistrate cum Chairman, Bihar Education Project, Rohtas (Annexure 2). The petitioners time and again made representations for allotment of works (Annexure 4 series). The petitioners state that works have been allotted to fourteen of the empanelled candidates by adopting pick and choose method. The petitioners state that the respondents vide advertisement, dated 18.6.2008 have again invited applications for selection of Supervisors and Engineers for construction work under the Bihar Education Project. The petitioners pray for stay of the said advertisement.
