Petitioner is an accused in Marhourrah P.S. Case No. 192 of 2012 on 07.09.2012 registered for the offence under Section 394 of the Penal Code against unknown alleging firing of shot and thereafter snatching of chain and money from the victim. It is submitted on behalf of the petitioner that he has been remanded in the present case after he was arrested in Bhagwan Bazar P.S. Case No. 149 of 2012 on 05.08.2012 registered for the offence under Section 379 also against unknown. Petitioner has been adjudged to be a juvenile on the date of occurrence of Marhourrah P.S. Case No. 192 of 2012. Notwithstanding the aforesaid finding about the juvenility of the petitioner on the date of occurrence, his request for grant of bail has been refused by the Juvenile Justice Board, Saran at Chapra as also the appellate authority as in the opinion of the authorities petitioner is likely to

come into contact with the criminals as he has been remanded at the instance of the police in the four cases, all registered against unknown.
Be that as it may, petitioner having been adjudged as a juvenile on the date of occurrence and having become adult cannot be allowed to remain in the remand home in view of Section 15 of the Juvenile Justice Act. In the interest of justice, he be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of Juvenile Justice Board, Saran at Chapra in J.E. No. 223 of 2013.
