This is an application seeking modification in the order dated 28.8.2012 passed in Cr. Misc. No. 28207 of 2012 in connection with Bagaha (Pathkhauli) P.S. Case No. 391 of 2011 wherein second and last line of para-2 which is based on the submission read as such “further petitioner carries no criminal antecedent on the ground that in fact several complaint cases have been filed before the Additional Chief Judicial Magistrate, Bagaha, by different complainants against five persons including the petitioner for which there is vivid reference in paragraph-5 of the application, but at the time during submission inadvertently the same could not be brought into notice and on the basis thereof altogether eleven police cases such as (i) Yoga Patti P.S. Case no.368 of 2010 dated 4.2.2010, (ii) Bagaha (Pathkhauli) P.S. case

Case No. 34 of 2011 dated 6.7.2011 (vi) Bagaha (Pathkhauli) P.S. Case No. 137 of 2011 dated 11.4.2011 (vii) Bagaha P.S. Case No. 389 of 2011 dated 14.10.2011, (viii) Bagaha (Pathkhauli) P.S. Case No. 390 of 2011 dated 14.10.2011, (ix) Bagaha (Pathkhauli) P.S. Case No. 391 of 2011 dated 14.10.2011, (x) Bagaha (Bhairoganj) P. S. Case No. 457 of 2011 dated 18.11.2011 and (xi) Balmiki Naga P.S. Case No. 7 of 2012 coupled with one more bearing Complaint Case No. C-68 of 2011 dated 27.1.2011 are standing against the petitioner and except the aforementioned twelve cases, there is no other case against the petitioner.

If it is so, the order dated 28.8.2012 be treated rectified and petitioner shall be released on bail on the same terms and conditions as imposed vide order aforementioned.

Let this order be communicated to the court below, i.e., Addl. Chief Judicial Magistrate, Bagaha, through fax at the cost of the petitioner.
