This is a petition for grant of regular bail in a case under Section 394 of the Indian Penal Code.

Petitioner is not named in the First Information Report. The occurrence is dated 02.07.2012 and looted mobile of the informant has been recovered from the possession of the petitioner on 20.07.2012 and no plausible statement has been given by the petitioner that someone has given the said mobile to him.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he has not been put on Test Identification Parade and he is in jail custody since 20.07.2012.

Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand)

with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Gaya in connection with G. R. P. S. Sone Nagar P.S. Case No. 10 of 2012, subject to the condition that the petitioner shall appear in the case on each and every date fixed by the court below and one of the bailors shall be the close relative of the petitioner who will file affidavit to the effect that the petitioner has no criminal antecedent which fact should be verified by the court below and thereafter the petitioner be released on bail.
