This is a petition for grant of regular bail in a case under Section 395 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected vide order dated 13.09.2012 passed in Cr. Misc. No. 31172 of 2012.

The driving license of the truck driver of the alleged truck which was snatched has been recovered on 19.01.2012 i.e. more than one and half months from the house of the petitioner. However, the occurrence is dated 03.12.2011 and the petitioner was apprehended but he was not put on Test Identification Parade.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.01.2012 i.e. more than one and three months.

the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ad hoc Additional Sessions Judge-5^th , Purnea in connection with Sessions Trial No. 490 of 2012 arising out of K. Nagar P. S. Case No. 317 of 2011, subject to the condition that one of the bailors shall be the close relative of the petitioner and another shall be the responsible person of the locality and further the petitioner shall appear in the case on each and every date fixed by the court below and any absence of the petitioner shall be subject to the satisfaction of the court below on reasonable grounds.
