This is a petition for grant of regular bail for offence under Sections 341, 323, 427, 379, 279, 337, 338, 307, 504 and 506/34 of the Penal Code and later on Section 302 of the Penal Code has been added after the death of the deceased.
There is allegation that the accused persons entered into the restaurant, ransacked it and they killed the guard by crushing his body by vehicle. The learned counsel for the petitioner, howeever, submits that the allegation against the petitioner is general and omni bus and in the case diary also the role of driving vehicle is upon Raghubeer and the vehicle belonged to him.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/(rupees ten thousand) with two sureties of the like amount each in connection with Bihta P.S. Case No. 225 of 2011 to the satisfaction of the Additional Chief Judicial Magistrate, Danapur, Patna.
