JUSTICE SHYAM KISHORE SHARMA ORAL ORDER 2 11-11-2013 Heard learned counsel for the petitioner and learned counsel for the State. The petitioner is one of the two named accused of the case, apprehends his arrest in a case registered under Sections 419, 420, 423, 468 and 471 of the IPC. It has been alleged that the petitioner and one coaccused Satya Narayan Singh have defalcated Rs. 11,11,383.20/and no entry of that amount was made in the balance register. Submission is that co-accused Satya Narayan Singh has been granted bail by the court below after depositing half of the alleged defalcated amount. The petitioner is ready to pay half of the amount as a condition for grant of anticipatory bail.

and the State, it is directed that the petitioner would deposit half of the defalcated amount and thereafter the petitioner namely Ambika Kumar Sinha is directed to be released on bail, on the event of his arrest or surrender within 20 days from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bairgania P.S. Case No. 136 of 2010, subject to the condition as laid down under Section 438(2) of the Cr.P.C. and the amount must be deposited within two months.
