This is a petition for grant of regular bail in a case under Sections 147, 148, 149, 341, 323, 325, 307 and 302 of the Indian Penal Code.

There is general and omnibus allegation that this petitioner along with others assaulted the deceased. However, there is specific allegation against Naseem that he assaulted with lathi on the person of the deceased.

Learned counsel for the petitioner submits that the co-accused having similar allegation has been granted bail vide order dated 01.11.2012 passed in Cr. Misc. No. 40445 of 2012.

Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Dhoraiya (Dhankund) P. S. Case No. 25 of 2012.
