The petitioner is in custody since 10.06.2013 in a case which has been registered under Sections 307, 326 and some other Sections of the IPC wherein it has been alleged that due to indiscriminate assault by hard and blunt substances the informant’s niece Rubi Kumari aged seven years received multiple injuries.
Learned counsel appearing on behalf of the petitioner is that the petitioner is a man of unsound mind and he does not know about the results of his attack. Further submission is that an unsound mind man cannot intent to cause death.
