2 12-11-2013 Above noted applications have arisen out of one occurrence, so they have been heard together and are being disposed of by this common order.

The petitioners are accused of a case registered under sections 147, 148, 149, 323, 307 and 302 of the Indian Penal

The informant Pramhansh Ram has alleged that he was abused by the petitioners and others. One Tej Bahadur Rai fired which hit Raju Ram who died on the spot and others have also fired. Firing of Mantu Rai caused injury in the arm of Sashi Ram and firing of Jitesh Rai caused injury to Bikarma Ram.

Submission is that none of the petitioners are assailants of the deceased. It has also been submitted that there were no intervening circumstances to spare the remaining injured.

Prayer for bail of the petitioners has been opposed by the learned APP assisted by the learned APP. It has been submitted that one of the petitioners has caused injury to Shahi Ram.

Be that as it may, considering the facts and circumstances of the case, the petitioners above named of all the three applications are directed to be released on furnishing of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar in connection with Rajpur P.S. Case No. 158 of 2013.
