The petitioner is one of the accused of the case which has been registered under Section 302 and some other Sections of the IPC and Section 27 of the Arms Act.

It has been alleged that the petitioner has fired which has caused injury and subsequently a firing was made which caused injury upon the chest of Munna Mishra and that firing was attributed to Shivajeet Mishra.

Submission is that Shivajeet Mishra is the assailant. By annexing Annexure-4, which is deposition of the informant in the trial court, it has been pointed out that the informant has not identified the petitioner which is apparent from para-5 of the

Considering the facts and circumstances of the case, the petitioner Brajesh Mishra @ Brijesh Mishra @ Brajesh Kumar Mishra is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Manoj Kumar, the learned Judicial Magistrate, 1^st Class, Bhojpur at Ara in connection with Trial No. 88 of 2012, arising out of Shahpur P.S. Case No. 23 of 2011.
