Earlier the prayer for bail of the petitioner was rejected by this Court vide order dated 22.11.2012 passed in Cr. Misc. No. 36889 of 2012 considering this aspect of the matter that name of this petitioner came in the statement of injured showing him as main assailant.

The submission on behalf of the petitioner is that name of this petitioner came in further statement of informant who disclosed before the Investigating Officer that he came to know about the involvement of the petitioner on the basis of rumour and after seven days of the alleged occurrence the police implicated the petitioner on the basis of statement of injured of this case.

The learned Sub Divisional Judicial Magistrate, Patna City has reported that case of the petitioner has not been committed to the court of Sessions as yet.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City in connection with Sultanganj P.S. Case No. 41 of 2012.
